1.0 INTRODUCTION
An Acceptable Use Policy (AUP) is a set of rules and conditions compiled by a network, system or website owner. These rules explicitly define and restrict the ways in which the respective network, system or website may be used.
The AUP of WebMagic Tanzania aims to clearly outline the purposes for which our customers cannot utilize our hosting services and position data on our network servers.
This Acceptable Use Policy (AUP) is an integral part of the Web Hosting Terms of Service which each customer agrees to abide by when signing up for an account with our web hosting company. Any violation of this AUP will be deemed a violation of our Web Hosting Terms of Service.
We, at our own discretion, shall determine whether an act constitutes a breach of this AUP and misuse of our services. We reserve the right to be the sole arbiter in determining the sufficiency of the presented evidence. We will respond accordingly and/or immediately terminate the provision of services should we receive a report or have sufficient proof of any prohibited conduct outlined in this AUP, or any other activity threatening the security of our hosting environment and/or our network of hosting servers.
In order to protect our company’s reputation and responsibilities, and guarantee state-of-the-art and reliable hosting services to all our customers, as well as privacy and security for all users, we – WebMagic Tanzania – hereby outline the following AUP rules and conditions.
2.0 SYSTEM ABUSE
Any customer in violation of our system or network security is subject to criminal and civil liability, as well as immediate account termination. Examples include, but are not limited to:
- Unauthorized access, use, probe, or scan of our system’s security, authentication measures, data or traffic.
- Interference with the service to any user, host or network including, but not limited to: e-mail bombing, flooding, deliberate attempts to overload the system and broadcast attacks, forging of any TCP/IP packet header or any part of the header information in an e-mail or newsgroup posting.
- Any attempt to harm a server or a customer of our web hosting services.
WebMagic Tanzania will immediately and resolutely react to any attempt at misuse of an Internet account or computer, or any attempt to gain unauthorized access to an internet account or computer by a WebMagic Tanzania customer. Such attempts include, but are not limited to: ‘Internet scamming’, password robbery, security hole scanning, running proxy scripts, introducing viruses, Trojan horses, worms, or any other malicious programs.
i) Background Operations/Programs on Servers
Background processes (such as ircd, irc bots, bnc, proxy scripts, etc.) are not permitted on any of our shared hosting servers, as they usually lead to CPU overload and can be used for malicious or illegal actions.
ii) Excessive Use of System Resources
All shared hosting plans are subject to resource limitations (CPU, Memory, disk space, and traffic). If an account exceeds allowed resources, the owner will be notified to reduce usage. Failure to do so may result in suspension. WebMagic Tanzania is the sole arbiter in determining excessive resource usage.
iii) Unlimited Hosting Limitations
Unlimited Hosting plans are designed exclusively for individual use by a single business entity or organization. They are intended to simplify management for clients who wish to create and manage multiple subdomains or domains under the same business or legal entity.
Unlimited Hosting is not intended for:
- Hosting multiple unrelated client accounts
- Reselling hosting services
- Acting as a hosting provider or web agency under one package
Hosting multiple unrelated client accounts under a single Unlimited Hosting package constitutes a violation of our Terms of Use. Such misuse may result in immediate account suspension or termination if not corrected within a reasonable timeframe (typically 7 days after notification).
This policy ensures fair resource allocation, maintains service quality for all customers, and prevents abuse of our Unlimited Hosting plans.
3.0 SPAM AND SPAMVERTIZING
SPAMMING IS PROHIBITED.
Users may not use our web hosting services to transmit, distribute, or deliver any unsolicited bulk or commercial messages (“spam”).
SPAMVERTIZING IS PROHIBITED.
This includes sending unsolicited spam messages to advertise a website hosted on our servers.
Any account found to be involved in spamming or spamvertizing will be subject to immediate suspension. We reserve the right to determine, at our sole discretion, whether any messages constitute spam.
4.0 INAPPROPRIATE OR UNLAWFUL CONTENT
Content published or transmitted via WebMagic Tanzania’s hosting services includes website content, email content, forum/blog postings, chat content, and any other type of content hosted on our servers.
Users are not permitted to post or link to content that is:
- Defamatory, abusive, obscene, or violates a person’s reputation or privacy
- Threatening, hateful, or contains hate speech
- Anti-religious or anti-human rights
- Encourages violence, illegal activities, or discrimination
- Contains child sexual abuse material or any illegal content
5.0 COPYRIGHTS
Users may not upload, store, or transmit any material that infringes on the intellectual property rights of others, including copyrights, trademarks, or patents. We will respond to valid DMCA or copyright infringement notices in accordance with applicable law and may suspend or terminate accounts that repeatedly infringe copyrights.
6.0 CORRECTIVE ACTIONS
WebMagic Tanzania reserves the right to take any action it deems appropriate in response to violations of this AUP, including but not limited to:
- Warning the account holder
- Temporary or permanent suspension of services
- Termination of the account
- Legal action where necessary

WebMagic Tanzania reserves the right to revise this Acceptable Use Policy at any time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of our services after any revision constitutes acceptance of the updated policy.
